Terms of Service

SilverMailer is a cold email campaign management tool that allows you to send email sequences to your own lead lists using your own email accounts. We provide the software and infrastructure; you are responsible for how you use it.

You agree to use SilverMailer only for lawful purposes. You must not use SilverMailer to:

• Send unsolicited bulk email (spam) in violation of applicable laws
• Send emails that harass, threaten, or harm recipients
• Impersonate another person or organization
• Violate any applicable law or regulation, including CAN-SPAM (US), CASL (Canada), GDPR (EU), or any other anti-spam law applicable in your jurisdiction
• Attempt to gain unauthorized access to any system or account
• Use the service to send malware, phishing emails, or fraudulent content

You are solely responsible for ensuring your email campaigns comply with all applicable laws in your jurisdiction and in the jurisdictions of your recipients. This includes obtaining proper consent where required, honoring unsubscribe requests, and including required disclosures.

You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at legal@silversoulsmail.com if you suspect unauthorized access.

You own your leads, your campaigns, and your email content. By using SilverMailer, you grant us a license to process and store this data to provide the service. We do not claim ownership of your data. For details on how AI features use your data — including inbound reply content — see Section 5 and our Privacy Policy.

Lead contact data: When you upload a lead list to SilverMailer (names, email addresses, job titles, company names, and similar firmographic data), you grant SilverMailer a non-exclusive, perpetual license to store, process, and use that contact data to operate and improve the platform. This includes enrichment, deduplication, and building a proprietary contact intelligence layer. We do not sell your lead lists to third parties, and we do not expose your list to other SilverMailer users. This license continues after account closure. If you wish to request deletion of your uploaded contact data after closing your account, email david@silversoulsgrowth.agency and we will process your request within 30 days.

You are legally responsible for your lead lists. By uploading a contact list to SilverMailer, you represent and warrant that you have a lawful basis under applicable law to process and contact each individual on that list. This includes compliance with GDPR, CAN-SPAM, CASL, and any other anti-spam or data protection law applicable in your jurisdiction or in the jurisdictions of your recipients. SilverMailer is a tool; responsibility for lawful outreach remains entirely with you.

SilverMailer includes AI-powered features, most notably Compass — a strategic intelligence tool that helps you build and refine outreach strategies. By using Compass and other AI features, you agree to the following:

• Data processing for your benefit: You grant SilverMailer a limited license to process your inbound email replies and campaign data for the sole purpose of improving your Compass strategy and AI feature accuracy. This includes classifying reply sentiment and building per-user memory.
• No shared training or cross-user use: We do not use your data to train shared AI models, and we do not share your campaign data, reply content, or strategic memory with other users.
• Third-party AI providers: AI features rely on third-party providers (Anthropic, Google Gemini, and/or OpenRouter). By using AI features, you acknowledge that relevant data — such as campaign context, reply text, and email sequences — will be sent to these providers under their respective privacy policies.
• AI outputs are estimates, not guarantees: All Compass strategy scores, copy recommendations, segment plans, and action plans are AI-generated estimates based on industry patterns. They are not performance guarantees. Results depend on factors outside SilverMailer's control, including lead list quality, domain reputation, market timing, offer-market fit, and execution.
• You remain responsible: You are fully responsible for all outreach content you send, even content generated or suggested by Compass or any other AI feature. AI assistance does not transfer legal or ethical responsibility for your campaigns to SilverMailer.

You are responsible for the email accounts you connect to SilverMailer. You must have the right to use any email address you add as a sender. We are not responsible for suspension or termination of your email accounts by third-party providers resulting from your use of SilverMailer.

We aim to keep SilverMailer available and working, but we make no guarantees of uptime or availability. The service is provided on a best-effort basis. We may perform maintenance, updates, or experience outages without notice.

To the maximum extent permitted by law, SilverSouls Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of SilverMailer, including but not limited to lost revenue, lost data, or reputational harm resulting from email campaigns or AI-generated recommendations. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim.

We reserve the right to suspend or terminate your account at any time if we determine you have violated these terms, particularly the acceptable use policy. You may delete your account at any time from the Settings page.

We may update these terms from time to time. We will notify you by email or in-app notice of material changes. Continued use of SilverMailer after changes constitutes acceptance of the updated terms.

These terms are governed by the laws of Nigeria. Any disputes shall be resolved in the courts of Lagos, Nigeria.
